88) e n tg e g e n g e tre te n . D iese E n ts c h e id u n g g e h t von d er g ru n d s ä tz lic h e n R e c h ts g ü ltig k e it d e r S ich erun gs- Ü b e re ig n u n g ü b e rh a u p t aus u n d s t e llt a ls a n e rk a n n te s R e c h t fe s t, daß d e r S c h u ld n e r a u c h u n p fä n d b a re G egenstände v e rä u ß e rn könne. E in e solche V e räu ß e ­ ru n g is t u n b e d in g t r e c h ts g ü ltig ; d ie s ich e ru n g sw e ise U e b e re ig n u n g müsse es d a h e r a u c h sein, da d er S c h u ld n e r in diesen F ä lle n s ic h s e in er V e rfü g u n g s ­ gew alt- ja n u r v o rü b e rg e h e n d entäuß ere. A u ß erde m kö nn e § 811 ZPO. ü b e rh a u p t n ic h t in s F e ld gezogen w erden, w e il e in g ru n d le g e n d e r U n te rs c h ie d zw ische n d ie s e r P fä n d u n g u n d d e r S ic h e ru n g s ü b e re ig n u n g be­

stehe. A u ß e rd e m w ir d a u f den a llg e m e in e n G ru n d s a tz ve rw iese n, daß je d e r f ü r d ie F o lg e n seines T u n s und U n te rla s s e n s s e ih st e in z u s te h e n habe u n d diese F o l­

gen n ic h t a u f andere a b w ä lz e n d ü rfe . D a ru m h e iß t es in d er E n ts c h e id u n g w ö r t lic h :

„ D e r S c h u ld n e r, w e lc h e r seinem G lä u b ig e r be­

s tim m te G egenstände a ls S ic h e rh e it a n b ie te t, b r in g t -da m it zum A u s d ru c k , daß e r s ic h im un­

g ü n s tig s te n F a lle a u c h ohne diese G egenstände b e h e lfe n ka n n . A u f d ie R ic h t ig k e it e in e r d e ra rtig e n E r k lä r u n g m uß s ic h d e r G lä u b ig e r ve rlasse n kö n ­ n e n ; sonst s c h w in d e t je d e S ic h e rh e it a u f diesem G e bie te des R e a lk re d its .“
