PREFACE

The ELENA Index of useful addresses lists organisations and individuals providing legal services and other forms of support to refugees and asylum seekers in Europe. It is not intended to be a complete directory of all organisations and persons active in the asylum field, but reflects the information provided by the ELENA Coordinators in the various countries. This list is only indicative of lawyers and organisations operating in this field and is not a formal endorsement by the ELENA network.

The ELENA Index is meant to serve as a tool for lawyers and legal counsellors participating in the European Legal Network on Asylum in their daily counselling and advocacy work. It provides addresses of colleagues and organisations in other countries which are useful when working with refugee and asylum law.

EUROPEAN COUNCIL ON REFUGEES AND EXILES

The European Council on Refugees and Exiles (ECRE) is a pan-European alliance of 90 NGOs protecting and advancing the rights of refugees, asylum seekers and displaced persons. Our mission is to promote the establishment of fair and humane European asylum policies and practices in accordance with international human rights law.

Working together with our members and partners to inform and persuade European authorities and the public, we monitor and denounce human rights violations while proposing and promoting fair and effective durable solutions. We accomplish our mission through research, advocacy and the sharing of knowledge and expertise.

ECRE strives for a Europe that protects refugees, asylum seekers and displaced persons with dignity and respect.

“Europe” refers to the broader geographic territory as well as “Europe” as an actor giving access to protection and providing assistance on its territory and outside.

The term “protects” is defined in the broadest sense, to encompass access to asylum, legal and physical protection and integration.

“Refugees, asylum seekers and displaced persons” to include all people seeking protection against their loss of rights due to displacement.

INTRODUCTION TO ELENA

The European Legal Network on Asylum (ELENA) is a forum of legal practitioners who aim to promote the highest human rights standards for the treatment of refugees, asylum seekers and other persons in need of international protection in their daily individual counselling and advocacy work. The ELENA network extends across most European states and involves some 500 lawyers and legal counsellors.

ELENA's objectives are pursued by:

 providing and reinforcing contact between legal practitioners in different European countries who work on asylum cases;

 facilitating the exchange of information and experience between legal practition ers across Europe;

 studying the implementation of national, European and international law relating to refugees and other persons in need of international protection;

 organising seminars on specific topics relating to refugee law and making the results ava ilable to practising lawyers;

 promoting the development of national networks of legal practitioners specialising in asylum law.

ELENA reinforces direct personal contact between lawyers to promote cooperation on individual cases and practice.

The work of ELENA is coordinated by the ECRE Secretariat in Brussels in continuous and close consultation with the ELENA National Coordinators comprising practising legal advisers from a range of European countries.

Under the relevant legislation asylum seekers have to be provided with a (government appointed) legal advisor by the asylum authority during their admission procedure as well as during their appeals procedure (in particular for lodging the appeal), including the right to be represented at the court hearing upon request.

For unaccompanied minor asylum seekers these legal advisors also serve as legal representatives during the admission procedure after which legal representation is taken over by the respective local youth welfare office.

In addition, asylum seekers are always entitled to appoint their own legal counsellor, e.g. from other refugee counselling organisations or a lawyer.

In procedures before the Constitutional Court and the Administrative Court where representation by lawyers is mandatory indigent asylum seekers may apply for legal aid.

VII. LEGAL AID

Legal aid is available according to Article 508/1- 508/25 of the “Code Judiciaire” and Royal Decree of 20 December 1999 and 18 December 2003. The legislation distinguishes between legal aid at the first instance authority i.e. ‘first line’

legal advice only and legal aid at the appeal stage known as ‘second line’ legal advice and

representation. A request should be made to the relevant Bar Association of each judicial district.

A lawyer is then designated who receives a small amount from the state.

The Brussels bar associations organise free legal aid for the refugees detained in the airport reception centre of Zaventem near Brussels (Centre Caricole).

VII. LEGAL AID

The overall responsibility of asylum issues in BiH lies with the Ministry of Security of the BiH Council Of Ministers. The ministry signed the protocol on cooperation with the Association “Vasa Prava BiH”, by which the association “Vasa prava BiH” was given exclusive right to provide free legal assistance and counselling to asylum seekers, refugees and victims of human trafficking.

The protocol also enables lawyers of “Vasa prava BiH” to access reception and asylum centres. Lawyers of the association are called on by the State Border Service when an asylum seeker first enters the country at some of the border crossings.

The association has 16 field offices and over 60 professional legal staff. The beneficiaries are mainly displaced persons, returnees, repatriates (whether they return to their places of origin or become internally displaced upon repatriation), refugees and minority members of the population. The

association to provide legal aid and information in all issues pertaining to asylum, human trafficking and refugees.

VI. LEGAL AID

With the entry into force of the Law on International and Temporary Protection (LITP) in summer 2015, legal aid i.e. legal counselling funded by the state, should be also available for applicants in the first instance procedure. The LITP specifies that applicants should, at their request, be provided with legal and procedural information on the approval of international protection, taking into account the circumstances of the specific case, in a language which it may be reasonably be presumed that they understand and in which they are able to communicate.

The right to counselling should be provided by organisations working to protect the rights of refugees or by attorneys with whom the Ministry shall conclude an agreement on the provision of legal counselling. However at the moment no such agreement is concluded. The Ministry of Interior has published a public call for providers of legal counselling in August 2018 and the results of the public call are expected soon.

According to the LITP, free legal aid in terms of representation is available in the court procedure and includes assistance in the preparation of a claim to the Administrative Court and representation before the Administrative Court i.e. in the first instance administrative disputes, if requested by the applicant and foreigners under transfer, under the condition that they do not possess sufficient financial resources or things of significant value.

The free legal Aid before the Administrative Court is provided by Attorneys at Law and lawyers from NGO.

According to the Legal Aid Law 2002 access to legal aid is granted only at the judicial review of an asylum application before the Administrative Court. No legal aid is

administrative examination ace of asylum applications. The provision of legal aid has been subjected to a “means and merits” test, which has been applied strictly leading to a very limited number of cases receiving such aid.
