VII. LEGAL AID

Asylum seekers are not entitled to state- funded legal aid prior to or during the first instance procedure conducted by the Asylum

Service. Before the Appeals Committees (entitled to examine administrative appeals against first instance rejections, deciding in second and final instance, art. 61 Law 4375/2016) appellants are entitled to free legal representation (art. 44 par.3 L. 4375/2016) via a lawyers’ registry maintained by the Asylum Service.

A final rejection of an asylum application can be challenged before the Second Instance Administrative Court. At this stage, free legal assistance is limited and is subject to (a) an insufficient means test, establishing the applicant’s inability to afford legal representation;

and (b) a merits test, determining that the application has a “probability” of success (Law 3226/2004). The choice of legal representative is made on the basis of a list drawn up by the relevant Bar Association. However, in order to submit an application for legal aid, the asylum seeker needs to hire a lawyer, he/she has no choice over his /her legal representative, as lawyers are appointed from the list designated by the Bar Association. The low rates and the great delays in remuneration awarded to legal aid lawyers act as a severe disincentive for legal professionals to take up asylum cases, adversely affecting both the availability and the quality of free legal assistance.

In Greece, free legal assistance and representation in all stages of the administrative and judicial asylum procedure has always been provided by NGOs according to their capacity. The provision of free legal assistance, as it is currently provided in Greece by NGOs lacking relevant funding, in no way may be perceived as satisfying the requirements set in the law and directly affects the quality of the asylum procedure.

VII. LEGAL AID

The Hungarian Legal Aid Act allows for ex post facto granting of legal aid (and reimbursement of legal fees) if the legal assistance does not require more than 2 hours, or if the legal assistance does not require more than 4 hours of work and the case is urgent.

In urgent cases, the client contacts the legal aid provider directly, and the legal aid provider will take care of claiming his/her fees and costs from the Legal Aid Office once the assistance has been provided to the client.

In all other cases, the beneficiary of legal aid first needs to have his/her application for legal aid approved by the Legal Aid

Office, and may only then approach a legal aid provider of his/her choice.

However, if there is a need for more hours to be spent on a given asylum case, in principle this is possible under the legal aid system – however, in practice this requires much more paperwork and is also time-consuming.
