QUESTIONNAIRE TO MEMBER STATES’ S AUTHORITIES

Background:

During its19 June 2020 Plenary session, European Parliament has decided to set up a committee of inquiry on the Protection of Animals During Transport within and outside the EU (ANIT).

It was given themandateto investigate alleged contraventions and maladministration in the application of Union law in relation to the protection of animals during transport within and outside the Union.

TheANIT Committeehas 30 members and shall submit its final report within 12 months from the date when it was set up, with possible two extensions, each time by 3 months.

In order to facilitate the work of the ANIT Committee, we kindly ask you to reply to the following questions about practices in EU Member States, proposed by the Members of the ANIT Committee and related with the mandate of the Committee.

Sanctions - Legal reference: Article 25 of Regulation (EC) 1/2005

1 Which sanctions do you have in place in case of non-compliance (whether financial or other types of penalties)?

Reply DE: Im Falle von Verstößen werden die erforderlichen Maßnahmen gemäß Artikel 23 der Verordnung (EG) Nr. 1/2005 ergriffen.

Hierunter fällt z. B. das Entziehen von Zulassungen für Transporteure und Transportmittel sowie von Befähigungsnachweisen der Fahrer. Im Einklang mit Artikel 25 der Verordnung (EG) Nr. 1/2005 hat Deutschland national insgesamt 35 Tatbestände festgelegt, die von den zuständigen Behörden als Ordnungswidrigkeiten mit Geldbußen von bis zu 5.000 Euro geahndet werden können. Die einzelnen Tatbestände finden sich in § 21 Absatz 3 der Tierschutztransportverordnung (https://www.gesetze-im- internet.de/tierschtrv_2009). Darüber hinaus ist es in Deutschland eine Straftat, einem Wirbeltier länger anhaltende oder sich wiederholende erhebliche Schmerzen oder Leiden zuzufügen, die mit Freiheitsstrafe bis zu drei Jahren oder mit Geldstrafe sanktioniert werden kann. Einem Tier ohne vernünftigen Grund erhebliche Schmerzen, Leiden oder Schäden zuzufügen, stellt eine Ordnungswidrigkeit dar, die mit einer Geldbuße bis zu 25.000 Euro geahndet werden kann. Auch sind die zuständigen Behörden berechtigt, die zur Beseitigung festgestellter Verstöße und die zur Verhütung künftiger Verstöße notwendigen Anordnungen zu treffen.

EN: In the event of infringements, the necessary measures will be taken in accordance with Article 23 of Regulation (EC) No 1/2005.

This includes, for example, the withdrawal of authorisations for transporters and means of transport as well as of drivers' certificates of competence. In accordance with Article 25 of Regulation (EC) No 1/2005, Germany has defined a total of 35 national offences that can be punished by the competent authorities as administrative offences with fines of up to 5,000 euros. The individual offences can be found in § 21 paragraph 3 of the Animal Welfare Transport Ordinance (https://www.gesetze-im-internet.de/tierschtrv_2009). In addition, it is a criminal offence in Germany to inflict prolonged or repeated significant pain or suffering on a vertebrate animal, which can be sanctioned with imprisonment of up to three years or a fine. Inflicting significant pain, suffering or harm on an animal without reasonable cause is an administrative offence punishable by a fine of up to 25,000 euros. The competent authorities are also entitled to issue the orders necessary to remedy established violations and to prevent future violations. (Cf. § 16a para. 1, § 17

4 How do you report breaches to other Member States?

Reply DE: Verstöße gegen die Verordnung (EG) Nr. 1/2005 werden Behörden anderer Mitgliedstaaten durch die nationale Kontaktstelle gemeldet, soweit dies erforderlich ist (vgl. Art. 23 Abs. 5, Art. 24 Abs. 2 und Art. 26 der Verordnung (EG) Nr. 1/2005). Die Mitteilungen erfolgen elektronisch und umfassen eine Darstellung des Sachverhalts samt etwaiger Bezugsdokumente. Zusätzlich vermerken die zuständigen Landesbehörden Kontrollergebnisse im TRACES-System, soweit dies vorgesehen ist.

EN: Infringements of Regulation (EC) No. 1/2005 are reported to authorities of other Member States by the national contact point as far as this is necessary (cf. 5 What follow up is given by Member States and the Commission?

Reply DE: Die rechtlichen Anforderungen an die Sachkunde von an Tiertransporten beteiligten Personen hängen von deren genauer Tätigkeit ab. Während Fahrer in bestimmten Fällen einen Befähigungsnachweis benötigen, ist dies z. B. beim Transport von Fischen oder Personen, die Tiere lediglich verladen/entladen oder an Sammel-/Kontrollstellen betreuen, nicht der Fall. Dementsprechend unterscheiden sich der Schulungsbedarf dieser Personen und die Möglichkeiten zur Anerkennung von deren beruflicher Aus- und Fortbildung. Im Allgemeinen werden entsprechende Schulungen in Deutschland von amtlichen Tierärzten durchgeführt oder von Stellen, denen diese Aufgabe seitens der jeweils zuständigen Behörde übertragen

Amtliche Kontrollen von Tiertransporten werden von amtlichen Tierärzten durchgeführt sowie in Absprache mit diesen teils auch von der Polizei oder anderen amtlichen Stellen. Fortbildungen in diesem Bereich betreffen z. B. die Zusammenarbeit verschiedener Behörden bei Kontrollen während des

Transports oder die Auswertung der Aufzeichnungen zum Temperatur- und Standortverlauf. Auf die Antwort zu Frage 3 wird verwiesen.

EN: The legal requirements for the expertise of persons involved in animal transport depend on their exact activity. While drivers may require a certificate of competence, this is not the case, for example, for the transport of fish or persons who only load/unload animals or look after them at assembly centers/control posts. Accordingly, the training needs of these persons and the possibilities for recognition of their professional education and training differ. In general, such training in Germany is provided by official veterinarians or by bodies to which this task has been delegated by the respective competent authority.

Official controls of animal transports are carried out by official veterinarians and, in consultation with them, sometimes also by the police or other official bodies. Further training in this area concerns, for example, the cooperation of different authorities during controls during transport or the evaluation of records on temperature and location. Reference is made to the answer to question 3.

7 How is this training organised? (i.e. duration and frequency/ location/species covered/characteristic of the final exam/ who are the trainers)

Reply DE: Das in der Antwort zu Frage 3 erwähnte Handbuch enthält Maßgaben für Schulungen zur Erlangung des Befähigungsnachweises für Fahrer. Danach beträgt der Schulungsumfang im Regelfall mindestens 15 Unterrichtseinheiten zu je 45 Minuten. Die Schulungsinhalte sind im Handbuch ausführlich beschrieben. Bei der Prüfung müssen, in Anwesenheit eines amtlichen Tierarztes, ein schriftlicher (multiple-choice) und mündlicher Teil

According to this, the scope of the training is normally at least 15 teaching units of 45 minutes each. The contents of the training are described in detail in the manual. During the examination, a written (multiple-choice) and oral part must be passed in the presence of an official veterinarian.

9 What are the criteria for approval of means of transport by road and livestock vessels?

10 How many of the approved vehicles were equipped with forced ventilation/air conditioning, with measurement of temperature, humidity and

ammonia, during the period 2018-2020?

Reply DE: Entsprechend der Verordnung (EG) Nr. 1/2005 wurden und werden Fahrzeuge des Typs 2 (für Beförderungen >8 Stunden) von den zuständigen Behörden nur dann zugelassen, wenn Sie über ein Belüftungssystem sowie eine Temperaturüberwachung und - aufzeichnung verfügen. Zu vollklimatisierten Fahrzeugen oder Systemen zur Messung von Ammoniak liegen keine Informationen vor.

EN: In accordance with Regulation (EC) No 1/2005, type 2 vehicles (for journeys >8 hours) have only been and will only be approved by the competent authorities if they have a ventilation system and a temperature monitoring and recording system. No information is available on fully air-conditioned vehicles or systems for measuring ammonia.

11 Which entities are involved in the approval of means of transport by road and livestock vessels (specialised veterinarians, others...)?

13 What are the requirements for the water arrangement to be used for unweaned animals for each means of transport? How is this verified?

Reply DE:Lange Beförderungen nicht abgesetzter Jungtiere stellen eine große Herausforderung für die zuständigen Veterinärbehörden dar.

Dabei geht es um das Mindestalter der Tiere und die damit einhergehenden physiologischen Voraussetzungen, insbesondere was die Art und Weise der Versorgung mit Flüssigkeit und Nährstoffen innerhalb der Transportmittel betrifft (vgl. EN: Long journeys of unweaned animals are a major challenge for the competent veterinary authorities. This concerns the minimum age of the animals and the associated physiological conditions, especially with regard to the way in which fluids and nutrients are supplied within the means of transport (cf. section D.3 of the manual mentioned in the answer to question 3 and https://www.openagrar.de/servlets/MCRFileNodeServlet/openagrar_derivate_00030363/FLI-Empfehlung-Tierschutz-beim-

13_eng-bf.pdf). In the revision of Regulation (EC) No 1/2005, long journeys of unweaned animals are a priority area for action against this background.

14 How is it verified that the ventilation systems can maintain temperatures inside the mean of transport (vehicle or vessel) within a range of between

5 °C and 30 °C, with a tolerance of ± 5 °C (cf. Annex I, Chapter VI, point 3.1 EU Animal Transport Regulation)?

Reply DE: Die zitierte Anforderung bezieht sich ausschließlich auf Typ-2-Straßenfahrzeuge und wird zunächst im Rahmen der Zulassung der Straßenfahrzeuge kontrolliert (vgl. Antworten zu den Fragen 8 bis 11). Des Weiteren berücksichtigen die zuständigen Behörden diesen Temperaturbereich, wenn sie über die Genehmigung der Transportplanung des Organisators entscheiden (vgl. Antwort zu Frage 22).

Dabei legen sie zu Grunde, dass die gängigen Belüftungssysteme die Innentemperatur der Transportmittel im fraglichen Temperaturbereich nicht unter die Außentemperatur senken können (vgl. Antwort zu Frage 24). Schließlich wird die Einhaltung des Temperaturbereichs auch anhand der Temperaturaufzeichnungen kontrolliert, wobei eine fehlende Standardisierung bei der Datenerfassung und -integrität die Behörden vor

Herausforderungen stellt. Insofern wird auf die Antwort zur vorausgehenden Frage verwiesen.

EN: The cited requirement refers exclusively to type 2 road vehicles and is initially checked as part of the road vehicle approval process (cf. answers to questions 8 to 11). Furthermore, the competent authorities take this temperature range into account when deciding on the approval of the organiser's journey plan (cf. answer to question 22). In doing so, they take as a basis that the common ventilation systems cannot reduce the internal temperature of the means of transport in the temperature range in question below the external temperature (cf. answer to question 24). Finally, compliance with the temperature range is also checked on the basis of temperature records, whereby a lack of standardisation in data collection and integrity poses challenges for the authorities. In this respect, reference is made to the answer to the previous question.

22 What verification and actions are taken regarding plausibility of the route plans provided?

Reply DE: Mit den Plausibilitätskontrollen wird überprüft, inwiefern die vom Organisator vorgelegte Planung rechtskonform und realistisch ist, wenn typische Reisegeschwindigkeiten (inkl. Lenk- und Ruhezeiten der Fahrer, Wartezeiten an Landesgrenzen) sowie Wettervorhersagen und Erfahrungen aus vorherigen Beförderungen berücksichtigt werden. Eine besondere Herausforderung für die Behörden der Länder und des Bundes besteht dabei darin, unternehmerseitige Angaben zu 24-stündigen Ruhepausen außerhalb der EU zu überprüfen. Auch dieser Punkt muss bei der Revision der

Verordnung (EG) Nr. 1/2005 Priorität haben (vgl. Antworten zu den Fragen 13 und 14).

EN: The plausibility checks verify to what extent the planning submitted by the organiser is legally compliant and realistic when taking into account typical travel speeds (incl. drivers' driving and rest times, waiting times at national borders) as well as weather forecasts and experience from previous journeys. A particular challenge for the authorities of the federal states and the federal government is to verify information provided by the companies on 24-hour rest breaks outside the EU. This point must also be given priority in the revision of Regulation (EC) No 1/2005 (cf. answers to questions 13 and 14).

23 What actions are taken to ensure compliance transport of unweaned animals?

Reply DE: Grundsätzlich ist festzustellen, dass die den Behörden gemäß Verordnung (EG) Nr. 1/2005 zur Verfügung stehenden Instrumente eine Kontrolle von Beförderungsabschnitten außerhalb der EU nur sehr eingeschränkt zulassen. Auf die Antworten zu den Fragen 14, 22, 26, 27 und 30 wird diesbezüglich verwiesen. Zu den Unterfragen:

Reply DE: Auf Ebene der Herkunftsbetriebe tragen grundsätzlich sowohl die Tierhalter als auch die Fahrer Verantwortung dafür, dass ausschließlich transportfähige Tiere verladen werden. Für andere Verlade- oder Umladeorte gilt dies sinngemäß. Inwiefern die beteiligten Personen schuldhaft gehandelt haben, wenn transportunfähige Tiere entgegen der Vorschriften transportiert wurden, ist von den zuständigen Behörden im Einzelfall zu bewerten. Auch die Transportunternehmer sind grundsätzlich für die Transportfähigkeit verantwortlich, insbesondere, wenn für ein bestimmtes Unternehmen eine Häufung von Verstößen auftritt, womöglich unter Beteiligung verschiedener Fahrer.

Wenn bei einer amtlichen Kontrolle während einer Beförderung oder am Bestimmungsort (z. B. Schlachthof) transportunfähige Tiere festgestellt werden, veranlasst die zuständige Behörde erforderlichenfalls weiterführende Maßnahmen zur Klärung der Verantwortlichkeiten (z. B. Informationsaustausch mit der am Versandort/Haltungsbetrieb zuständigen Behörde, pathologische Untersuchungen).

Ergänzend zur Vorgabe der Verordnung (EG) Nr. 1/2005, Tiere nicht bei zu 90 % oder mehr fortgeschrittener Trächtigkeit zu transportieren, ist es in Deutschland verboten, ein Säugetier zur Schlachtung abzugeben, das sich im letzten Drittel einer Trächtigkeit befindet (ausgenommen Schafe und Ziegen sowie Abgabe aus tierseuchenrechtlichen Gründen oder nach tierärztlicher Indikation).

EN: At the farm of origin level, both keepers and drivers are responsible for ensuring that only animals fit for transport are loaded. This applies analogously to other loading or reloading sites. The extent to which the persons involved have acted culpably if animals unfit for transport were transported contrary to the regulations must be assessed by the competent authorities in each individual case.

Transporters are also generally responsible for fitness for transport, especially if there is an accumulation of infringements for a particular company, possibly involving different drivers.

If, during an official inspection during a journey or at the place of destination (e.g. slaughterhouse), animals unfit for transport are found, the competent authority will, if necessary, initiate further measures to clarify responsibilities (e.g. exchange of information with the authority responsible at the place of departure/holding, pathological examinations).

In addition to the requirement of Regulation (EC) No. 1/2005 not to transport animals with 90% or more advanced pregnancy, it is prohibited in Germany to hand over a mammal for slaughter that is in the last third of pregnancy (except for sheep and goats and handing over for animal health reasons or according to veterinary indication). Violations are punishable by fines of up to 5,000 euros.
