Inheritance law regulates to whom a person’s estate is left after their death, what is to be done with the estate, and who is to pay the debts relating to the estate. Inheritance law is part of the German Civil Code (Bürgerliches Gesetzbuch, BGB).
Disabled persons who receive social welfare benefits and/or integration assistance must use assets that they acquire by inheritance to cover their needs as specified by social welfare law or their need for integration assistance. The social assistance authority or integration assistance agency is obligated to provide benefits only when the assets, minus an amount of exemption of usually EUR 5,000, has been used up. If parents wish to leave tangible assets from an inheritance
to their disabled children, it is therefore recommended to prepare what is known as a disabled person’s will. This way, the social welfare office or integration assistance agency can be prevent-ed from accessing the estate. Central elements of the disablprevent-ed person’s will include the ap-pointment of the disabled person as the provisional heir and the order of the execution of the will. Due to the fact that the regulations to be specified are highly complicated, parents are strongly advised to seek legal advice from a lawyer.
Information for foreign nationals
When a foreign national living in Germany dies, the question as to who is to inherit their estate is generally decided on the basis of the law of their home country. However, the law of their home country may refer back to the application of German law. The question as to whether foreign nationals can prepare what is known as a disabled person’s will under German inheritance law should therefore be reviewed with great care by a lawyer.
