1. Granting of rights
The above-named person holds the exclusive rights to the aforementioned work.
The author hereby grants the Federal Institute for Occupational Safety and Health (BAuA) the non- exclusive and royalty-free right of use without any restrictions regarding location or time as follows: the publication of the work on the internet and intranet sites of BAuA (www.baua.de) and also in the printed publications of BAuA in such a way that is accessible to the public.
The author also grants BAuA the right to duplicate his or her work and to make it publicly accessible to third parties (also refer to Article 19 a of the German Copyright Act (UrhG) – Right to Make Publicly Accessible). The author also provides BAuA with his or her consent to make such work available in the form of a PDF file in printable format on the internet and intranet sites of BAuA.
BAuA is not obliged to exercise the rights that are granted by this agreement.
2. Rights of third parties
The author represents and warrants that the publication of his or her work does not infringe any third- party rights, in particular with regard to any graphic material and text that it may contain (e.g. photo- graphs, graphics, drawings, figures, etc.). If persons are depicted on photographs, the author gives his or her assurance that s/he has been granted the written consent by the person(s) depicted or by the latter‘s legal representative, and that s/he is therefore entitled to use the photographs without restriction.
3. Liability
The author hereby indemnifies BAuA from all and any claims by third parties due to BAuA’s contrac- tual use of the work.
BAuA shall not accept any liability if a third party unlawfully downloads the author‘s work, modifies it or publishes it at another place without the author‘s consent.
4. Withdrawal of the declaration of consent
The author has the right to withdraw this declaration of consent by appealing to Article 42 of the German Copyright Act (UrhG) (the work no longer corresponds to the author‘s conviction).
