How do I remove a participant from a multilateral case?
AD_BUC_04_Subprocess: Remove Participant
Description:The Administrative sub-process 'Remove Participant' is used in a situation where a case is already established and a participant discovers, for some reason, that there is a need to remove an existing participant from the case.
Please note that the Case Owner can remove any participants except itself. Conversely, any Counterparty can only remove itself from a case, but cannot effect the removal of any other institution. Moreover, removal of any Participant is possible only as long as at least two Participants remain assigned to the case.
Legal base:
Basic Regulation (883/04)
SED Article 76
X006 Remove Participant
Glossary of relevant terms used in AD_BUC_04_Subprocess:
Actor name Description Triggering
Participant
The Triggering Participant (you) is an active participant in the main process who triggers this BUC. This will be an Institution where the main process permits their role to do so Other
Participant(s)
Other Participant(s) represents all other active participants in the main process (except the institution to be removed). This will be one or more Institutions as determined by the main process.
Participant to be Removed
The Participant to be Removed is the institution who, for whatever reason, it has been determined that they need to leave the case
Steps:
If you want to remove an institution from the case, you have to identify the currently active institution in the list of case participants. Then, fill out a 'Remove Participant' SED X006 detailing the reasons for removing this participant and send it to the Other Participant(s) and the Participant to be removed.
The Participant to be removed receives the X006 and takes the necessary action to no longer be involved in the case. The Other Participant(s) receive the X006 and take note that the Participant to be removed has been removed and no longer send to this institution any SED for this case.
Alternative scenario:
If the Participant to be removed is no longer a valid destination (e.g. the Institution is closed), then you should send the X006 only to the Other Participant(s) of the case.
Special Requirements:
- Active participants in this case are those participants defined in the parent process which invoked this sub-process.
- Only the Counterparty can remove himself/herself (on the condition that there will still be at least 2 remaining participants after the removal). Nobody (not a Counterparty, not a Case Owner) can remove the Case Owner from a case.
If there are only 2 participants in a Case, Removal of a participant MUST never be possible.
