being aware of t h e high importance of t h e r a t i o n a l management and pollution control of t h e Danube water f o r t h e welfare and t h e health of t h e peoples of t h e Danube c o u n t r i e s a s w e l l as f o r t h e economical and' social development t h e r e o f ,

-

being convinced t h a t besides t h e coordination of national e f f o r t s and n e c e s s a r y measures among t h e neighbouring Danube coun- t r i e s , t h e efficiency of actions against t h e pollution of t h e Danube water could essentially b e i n c r e a s e d by means of a multilateral cooperation of a l l Danube countries,

taking into account t h e importance of t h e educational work to b e performed in wide c i r c l e s of t h e youth in t h e i n t e r e s t of p r o t e c t - ing, p r e s e r v i n g and especially improving t h e quality of t h e Danube water,

-

guided by generally a c c e p t e d principles and r u l e s of international law, including t h e Constitution of United Nations, in a c c o r d a n c e with t h e i n t e r e s t s and t h e sovereignty of a l l Danube s t a t e s ,

-

striving f o r t h e consideration of t h e content of t h e Closing Docu- ment of t h e Conference f o r European S e c u r i t y and Cooperation a s well as of t h e t h e s e s of t h e Closing Document a c c e p t e d on t h e Madrid meeting of t h e r e p r e s e n t a t i v e s of t h e European countries, in o r d e r t o promote regional cooperations aiming a t pollution con- t r o l and utilization of water r e s o u r c e s ,

d e c l a r e t h e following:

1. The p r e s e r v a t i o n and r a t i o n a l utilization of water r e s o u r c e s , t h e prevention, termination and c o n t r o l of t h e i r pollution constitute a n o r g a n i c p a r t of t h e national water management and environment p r o - tection policies of t h e Governments of t h e Danube countries.

Taking into consideration t h e f a c t t h a t t h e water of t h e Danube is being utilized f o r various purposes, among o t h e r s f o r water supply of t h e population, t h e Governments of t h e Danube c o u n t r i e s

in t h e i n t e r e s t of t h e p r e s e n t and f u t u r e generations as well

are r e a d y to t a k e measures, according t o t h e p r e s c r i p t i o n s of t h e legal r u l e s valid in t h e d i f f e r e n t c o u n t r i e s and within t h e frame of t h e techno-economic possi- bilities, t o safeguard t h e water of t h e Danube from pollution, with spe- cial r e g a r d t o dangerous and radioactive substances and t o a g r a d u a l d e c r e a s e of t h e d e g r e e of pollution, taking into account a l s o t h e eco- logical requirements connected with t h e water of t h e Danube. The Governments a l s o effectuate o n t h e i r r e s p e c t i v e t e r r i t o r i e s a sys- tematic monitoring of t h e waste waters r e l e a s e d into t h e Danube and authorize t h e introduction of t h e s e waters only in a c c o r d a n c e with t h e legal r u l e s valid in t h e different countries; t h e y a l s o c o n t r o l t h e accomplishment of t h e conditions of introduction and at t h e same time o b s e r v e t h e changes in water quality.

2. The complex measures, worked o u t f o r long r a n g e s by t h e p r o p e r e f f o r t s of t h e Governments of t h e Danube countries, and especially t h e execution of t h e s e measures, c a n be completed and confirmed, in a way corresponding t o t h e goals defined above, by means of bi- and multila- teral international cooperation.

F o r t h i s p u r p o s e , t h e Governments of t h e Danube c o u n t r i e s s t r i v e f o r t h e following:

2.1 In t h e framework of t h e i r bi- a n d m u l t i l a t e r a l c o o p e r a t i o n s t h e y c a r r y o u t systematical o b s e r v a t i o n s o n t h e w a t e r quality of t h e Danube, on t h e b a s i s of programmes a n d methods enabling t h e collection of com- p a r a b l e d a t a . To t h a t end, t h e y work o u t a p p r o p r i a t e programmes a n d methods n o t l a t e r t h a n within o n e o r two y e a r s following t h e signing of

t h i s Declaration. ,

The w a t e r quality o b s e r v a t i o n s will b e p e r f o r m e d in t h e crosss-sections w h e r e t h e Danube s t e p s from t h e national t e r r i t o r y of o n e Danube c o u n t r y t o t h a t of a n o t h e r ; when t h e Danube c o n s t i t u t e s t h e state b o r d e r , in t h e beginning a n d final crosss-section of t h e common f r o n - t i e r r e a c h , o r in o t h e r s e c t i o n s determined in t h e f r a m e of b i l a t e r a l r e l a t i o n s . If i t is n e c e s s a r y , t h e Danube c o u n t r i e s i n t e r e s t e d c a n d e t e r m i n e , in t h e f r a m e o f . t h e i r b i l a t e r a l r e l a t i o n s , o t h e r c r o s s s - s e c t i o n s as well, s u c h as t h o s e up- a n d downstream of t h e major t r i b u - taries of t h e Danube, u p and downstream of major towns a n d impounding r e s e r v o i r s , a n d f u r t h e r i n t h e main b r a n c h e s of t h e Danube d e l t a at t h e Black S e a t h o s e r e p r e s e n t a t i v e crosss-sections, downstream of which n o a n t h r o p o g e n i c impact c a n modify t h e w a t e r quality a n y more.

In 6 months time, a f t e r having fixed t h e methodology, w a t e r quality o b s e r v a t i o n s a n d a n a l y s e s will b e s t a r t e d , a c c o r d i n g to t h a t methodol- ogy. In two y e a r s a f t e r t h e s t a r t of t h e o b s e r v a t i o n s t h e w a t e r quality c h a r a c t e r i s t i c s of t h e Danube, as o b s e r v e d during t h e given p e r i o d , will b e determined by d a t a p r o c e s s i n g a c c o r d i n g t o t h e methodology fixed.

2.2. The Governments inform e a c h o t h e r a b o u t t h e i r o r g a n s competent f o r monitoring of t h e pollution of t h e water of t h e Danube a n d e s t a b l i s h t h e methods and t h e programme of w a t e r quality observations; t h e y a l s o designate t h e i r o r g a n s

which t h e r e s u l t s a n d evaluations r e g a r d i n g t h e w a t e r quality of t h e Danube as well as a l l u r g e n t informations con- n e c t e d with a c c i d e n t a l pollutions and m e a s u r e s aiming at t h e i r removal, mutually h a v e t o b e r e p o r t e d .

2.3 The Governments will study t h e possibility of automatization of t h e o b s e r v a t i o n of t h e Danube's water quality a n d of t h e installation of automatized monitoring systems in t h e cross-sections mentioned a b o v e . 2.4 The Governments will inform e a c h o t h e r , t h r o u g h t h e i r above-

mentioned competent o r g a n s , whenever n e c e s s a r y b u t at l e a s t e v e r y two y e a r s , a b o u t t h e r e s u l t s of a n a l y s e s a n d evaluations p e r f o r m e d in t h e o b s e r v a t i o n crosss-sections. They inform e a c h o t h e r o n t h e i r m e a s u r e s aiming at t h e p r o t e c t i o n of t h e Danube w a t e r from pollution as well as a b o u t t h e a g r e e m e n t s taking e f f e c t between Danube coun- t r i e s t o t h i s p u r p o s e , including t h e r e s u l t s a c h i e v e d b y means of t h e i r r e a l i z a t i o n ; t h e y a l s o inform e a c h o t h e r a b o u t t h e t e c h n i c a l solution of sewage t r e a t m e n t , a b o u t w a t e r analyses, investigations of w a t e r r e s o u r c e s a n d t h e i n t e r n a l s t a t e norms f o r w a t e r quality p r o t e c t i o n . 2.5 The Governments promote, whenever n e c e s s a r y , b u t at least e v e r y two

y e a r s , t h e o r g a n i s a t i o n of t h e meeting of t h e r e p r e s e n t a t i v e s of t h e competent o r g a n s of t h e Danube c o u n t r i e s aiming at comparing t h e results of t h e a n a l y s i s a n d evaluation of t h e Danube's w a t e r quality as well as at t h e solution of o t h e r problems a r i s i n g in t h e c o u r s e of t h e c o o p e r a t i o n t o b e r e a l i z e d o n t h e b a s i s of t h i s Declaration.

2.6 The Governments inform e a c h o t h e r a b o u t t h e i r competent o r g a n s working o u t t h e b a l a n c e s of water r e s o u r c e s a n d n e e d s , a n d a b o u t t h e r e s u l t s of t h e s e works whenever r e g a r d i n g a f r o n t i e r r e a c h of t h e Danube. Within a y e a r , a f t e r signing this Declaration, a harmonized method f o r comparing t h e w a t e r b a l a n c e s of t h e Danube c o u n t r i e s will b e developed in o r d e r to obtain comparable r e s u l t s in t h e b o r d e r s e c - tions. On t h i s b a s i s , t h e y will s t r i v e f o r compiling t h e summarized water b a l a n c e of t h e Danube.

3. In t h e i n t e r e s t of r e a l i z i n g t h e goals of t h i s Declaration, t h e Govern- ments of t h e Danube c o u n t r i e s will gradually s t r i v e t o a r r a n g e , by means of bi- a n d multilateral a g r e e m e n t s , t h e c o n c r e t e i s s u e s of t h e water quality c o n t r o l of t h e Danube which are of b a s i c i n t e r e s t f o r t h e r e s p e c t i v e s t a t e s .

4. In o r d e r t o fight against floods on t h e Danube a n d against t h e dangerous i c e phenomenon causing floods, t h e Governments of t h e Danube c o u n t r i e s will inform each o t h e r , through t h e i r competent organs, a b o u t t h e development and passing of floods as well as about t h e i c e phenomena f o r e c a s t f o r the crosss-sections s e l e c t e d by a g r e e - ments.

with striving f o r taking measures f o r protecting. p r e s e r v i n g and improving t h e environment and f o r t h e enforcement of increased responsibility. p a r t i c u l a r l y in t h e field of protecting waters from pollution.

6. In o r d e r t o r e a l i z e t h e measures f o r e s e e n by t h i s Declaration, t h e com- p e t e n t o r g a n s of t h e Danube c o u n t r i e s

t o b e appointed f o r taking t h e s e measures

will coordinate t h e i r measures in a l t e r n a t i o n with e a c h o t h e r , beginning with t h e competent o r g a n of t h e state taking t h e initiative and continuing according t o t h e o r d e r of succession a g r e e d upon at t h e f i r s t meeting.

7. In o r d e r to successfully c a r r y o u t t h e measures laid down by t h i s Declaration, t h e Governments of t h e Danube countries will t a k e advan- t a g e of t h e possibilities of cooperation with t h e United Nations Organi- sation, with i t s specialized o r g a n s as well as with o t h e r international organisations i n t e r e s t e d .

The original copies of t h i s Declaration will b e guarded by t h e Government of Romanian Socialist Republic.

The Government of e a c h Danube c o u n t r y will r e c e i v e from t h e Government of Romanian Socialist Republic t h e a t t e s t e d duplicate of t h i s Declaration.

Each Danube state will make public and s p r e a d t h e t e x t of t h i s Declaration and e n s u r e i t s widespread knowledge.

The Government of t h e Romanian Socialist Republic i s invited to hand o v e r t h e text of t h i s Declaration t o t h e S e c r e t a r y General of t h e United Nations Organization, in o r d e r t o pass i t , as a n official working document of t h e United Nations Organisation, to all members of t h a t Organisation,

f u r t h e r m o r e t o hand i t o v e r t o t h e S e c r e t a r y General of t h e World Meteoro- logical Organisation, t o t h e Managing D i r e c t o r of t h e United Nations Educa- tional, Scientific and Cultural Organisation, t o t h e D i r e c t o r of t h e World Health Organisation, to t h e Managing S e c r e t a r y of t h e United Nations Organisation's Economic Commission f o r Europe, t o t h e D i r e c t o r General of t h e International Atomic Energy Agency, to t h e P r e s i d e n t of t h e Danube Commission and t o t h e Director of t h e United Nations Organisation's P r o - gramme f o r Environmental Protection.

The r e p r e s e n t a t i v e of t h e Danube c o u n t r i e s have signed t h e Declaration aware of t h e high importance of t h i s document.

Accepted in Bucharest, o n t h e 13th of December, 1985, in Bulgarian, Czech, Hungarian, German, Russian, Romanian and Serbo-Croatian languages.
