WHO IS RESPONSIBLE FOR LOST PROPERTY?

Within the Innsbruck municipal council, the Lost Property Office, which comes under the Department for Citizens Advice and Public Relations, is responsible for lost prop- erty. The work of this office consists of logging and stor- ing items of lost property (lost and left-behind belongings) found in the area for which it is responsible (the municipal territory of Innsbruck), and then tracing the owner. An item of lost property is either handed back to the person who lost it or - if all deadlines have expired - to the finder.

From everyday objects such as glasses, keys, mobile phones, um- brellas to jewellery and musical instruments or even dentures or wheelchairs: the Municipal Lost Property Office in Fallmerayer- straße 2 is the place to deposit found objects and to look for any- thing (believed to be) lost and for- gotten.

The citizens of Innsbruck are fortunate, because Innsbruck is a city of honest finders: around 7,300 found objects were brought to the Lost Property Office in 2017 – while only some 3,000 losses were reported. No matter how peculiar or valu- able the found objects may be: the friendly and considerate employees of the Lost Property Office will actively search for the owners of lost valuables and draw up loss reports. They can be sure the owners will be greatly relieved and grateful when their lost property is safely returned.

HONESTY IS THE BEST POLICY

The finder of a lost or left-behind article is obliged to report the find immediately to the authorities, to hand in the article, and to provide information on all important facts which may be of help in identifying the owner.

The person who finds a lost or left-behind article is not obliged to report the find, if the item is returned to its owner before a report is made to the Lost Property Office concerned, or if the value of the find is nore than 10 euros. The latter does not apply, however, if it is clear that the recovery of the lost property is of consider- able importance to its owner.

HOW HIGH IS THE FINDER’S REWARD?

The finder has the right to receive a reward from the owner of the lost property:

for lost belongings, the finder’s reward amounts to 10 % of the value, up to a value of 2,000 euros

for left-behind belongings, the finder’s reward is 5 % of the value, up to a value of 2,000 euros

for lost belongings worth more than 2,000 euros, the finder’s reward amounts to 5 % of their value

for left-behind belongings worth more than 2,000 euros, the finder’s reward amounts to 2.5 % of their value

If somebody discovers a treasure, the finder and the owner of the plot of land concerned are each entitled to 50 % of the value of the treasure.

WHAT ARE LOST OR LEFT-BEHIND ARTICLES?

The legal position is that Lost Property Offices are responsible not only for lost items but also for items left behind. Movable property is regarded as “lost” if control is lost over it, without the consent of the owner, and it does not enter the sphere of influ- ence of another person (for example, a wal-

let which gets lost on the street). Movable property is regarded as

“left behind” if control is lost over it, without the consent of the owner, but it is left behind in a place supervised by another person (for example, a handbag which gets lost in a hotel).

People who have lost their belongings can phone 0900 600 200 (subject to a charge of max. € 1.36/min.) round the clock to report the loss. This call centre also undertakes searches for the owners of lost articles.

WHO CAN ISSUE A LOST PROPERTY REPORT?

The Municipal Lost Property Office confirms in writing that the loss has been reported. Lost property reports that are to be used to initiate replacement documents can only be accepted by the police. This applies, for example, in the case of driving licences, (car) registration certificates, licence plates and weapons/fire- arms documents/licences.
