1. Foreword and explanations

Regulation (EC) No 1013/2006 of the European Parliament and of the Council of 14 June 2006 on shipments of waste (Waste Shipment Regulation - WSR) establishes a system of supervision and control of transboundary movements of waste within, into and out of the European Union. This regulation has been applied since 12.07.2007. It transposes the two international legal instruments on transboundary movements of waste, the Basel Convention on the Control of Transboundary Movements of Hazardous Wastes and their Disposal of 22 March 1989 and the Decision of the OECD Council on the Control of Transboundary Movements of Wastes Destined for Recovery Operations of 30. March 1992 (OECD Decision), into directly applicable Union law.

The WSR distinguishes its regulations according to whether waste is destined for

 disposal (e.g. landfilling, incineration without energy recovery) or

 recovery (e.g. recycling, waste incineration with energy recovery).

The wastes are divided into the following categories:

 so-called "green waste" (Annex III, IIIA and IIIB of the WSR),

 so-called "amber waste" (Annex IV and IVA of the WSR) and

 wastes not listed in the above-mentioned annexes.

Depending on whether a shipment of waste is destined for disposal or recovery, the countries involved and the waste categories, a specific control procedure applies in each case. For each individual shipment, it must be checked based on whether a shipment is destined for disposal or recovery and on the waste classification whether and with which control procedure a shipment is possible.

The following list provides a quick overview for exports for recovery of Green Listed wastes (Annexes III and IIIA) to countries to which the OECD Decision does not apply (non-OECD countries).

2. Explanation of the entries in the columns

The first five columns contain up-to-date information on the respective countries that is relevant for all transboundary waste shipments, e.g. whether the respective country is a Party to the Basel Convention (marked with the accession date in each case), whether it is a member of the OECD and whether it is a Member State of the EU.

Columns six to eight show the requirements that apply exclusively to exports of green waste in Annex III and IIIA from EU Member States to non-OECD countries, as regulated in Regulation (EC) No 1418/2007 of 29 November 2007, as last amended by Regulation (EU) 2022/520 of 31 March 2022.

2.1 Export of Green Waste from the EU

Shipments of Green Waste within the EU must be accompanied by general information ("consignment information" according to Annex VII of the WSR). Furthermore, the person who arranges the shipment and the consignee must conclude a contract (Art. 18(2) WSR). Prior notification and consent by the authorities is not provided for.

Art. 37 of the WSR stipulates that the Commission shall ask all non-OECD countries whether they consent or not to the import of waste for recovery listed in Annexes III and IIIA or whether they wish the control procedure (i.e. the procedure of prior written notification and consent pursuant to Art. 35 WSR) to be applied. Mixtures in Annex IIIA containing slags from precious metal and copper produc- tion and listed in Annex IIIA point 2.(d) and (e) are a special feature, as they are not eligible for exports to non-OECD countries. Another peculiarity is the different waste codes for plastic waste, where different waste codes apply for exports from the EU to non-OECD countries than for shipments within the EU.

A consultation of the non-OECD countries regarding the export of Annex IIIB waste from the EU is not provided for in Art. 37(1) of the WSR. Therefore, according to Art. 37(5) of the WSR, the notification obligation applies to the export of Annex IIIB waste, unless an export ban applies according to Art. 36 of the WSR.

According to Art. 37(2) of the WSR, exports of green waste from the EU for recovery in non-OECD countries are to be regulated by the Commission. Regulation (EC) No. 1418/2007 of 29 November 2007, as last amended by Regulation (EU) 2022/520 of 31 March 2022, lays down rules for these exports from the EU and lists them in table form in the Annex. According to the specifications of the WSR, the following options are possible:

 import prohibition (ban) for states that do not want them (column (a) in the annex);

 establishment of a control procedure (i.e. the procedure of prior written notification and consent according to Article 35 of the WSR) (column (b) in the Annex);

 no control under waste legislation (column (c) in the Annex); or

 other control procedures of the country of destination according to its national law (column (d) in the Annex).

Some non-OECD countries have established obligations in their national legislation that go beyond the scope of Regulation (EC) No 1418/2007. In the following list, the wastes that are subject to these measures to be monitored by the respective country under its own responsibility have been included with the entry "without control (d)". The column "Remarks" partly indicates which provisions are con- cerned.

For those States, which have not replied to the Commission's request or to which no request has been sent for any reason, the procedure of prior notification and consent according to Art. 35 of the WSR applies (see second subparagraph of Art. 37(2) WSR).

2.2 Disclaimer

It should be noted that the following list is for information only and that no rights or obligations other than those set out in the published legal texts (which alone are authoritative) can be derived from it. The legal basis is Commission Regulation (EC) No. 1418/2007 of 29.11.2007 concerning the export for recovery of certain waste listed in Annex III and IIIA to Regulation (EC) No. 1013/2006 to certain countries to which the OECD Decision on the control of transboundary movements of wastes does not apply (OJ No L 316, 29.11.2007, p. 6), as last amended by Regulation (EU) 2022/520 of 31.03.2022 (OJ No L 104, 1.4.2022, p. 63).

2.3 Notes on reading the entries

The surveyed countries have partly named different processes for sub-items of individual waste codes, e.g. for sub-items (sub-indents) such as "solid sulphur" from B2040 or individual metals from B1010.

If a subgroup is named, such as lanthanides or transition metals from B1120, this applies to all items of the subgroup (i.e. all lanthanides or transition metals listed there).

The indications given in the list are to be considered in context for each country. That is, the term "all other" includes all other wastes in Annex III and all mixtures of wastes in Annex IIIA not specifically listed for that country.

The term "all" includes all wastes in Annex III and all mixtures of wastes in Annex IIIA and the term "all other wastes" includes all sub-items (sub-indents) of a waste entry not previously mentioned.

The replies of the third countries have been included in the Annex to Regulation (EC) No 1418/2007 in column form as follows:

column (a) These countries have declared themselves against import. An export of the correspondingly named waste to the respective country is banned.

column (b) The export of "green wastes" (Annexes III and IIIA) or the categories of these wastes mentioned by the states must be subject to the procedure of prior written notification and consent according to Art. 35 WSR.
